| Notes for Hugh (Spouse 1) |
Hugh Dykes wrote his will 21/10/1749. At the time he lived at Birkston Street. It went to probate 28/12/1750 and was granted 5/1/1750. The full text of his will follows.
"The last will and testament of me, Hugh Dykes of Liverpool in the County of Lancaster, Cordswainer follows. FIRST it is my will and mind that all my final debts, funeral expensesand the charges of my will be paid and satisfied out of my personal estate and all the remainder and residue of my personality together with my real estate I give, devise and bequeath the same and every part thereof to my loving wife for her support and maintenance during her natural life and after her decease I will that my son John Dykes have my house in Bithster Street he paying a valuation for the same at the estimate and valuation of my Executors. And I give to my son John the sum of five pounds and to my son in law William Bryers five pounds and to my son in law Hugh Bullen five pounds and to my son in law James Rathbone ten pounds and to my grandson Hugh Dykes and my grandson Thomas Dykes both of them two pounds ten shillings and I give my son in law Zacharias Ellas two shillings and and six pence and I give to my executors hereafter named the sum of one pound one shilling to each of them and in case there shall not be effects sufficient to pay off the above legacies after my wife's decease then everyone to be paid in proportion to their legacies as the effects will hould (sic) out. But in the case there be an overplus my will and mind is that it be equally divided amongst the legacies share and share alike (the executors excepted). And if any Legacie or Legacies shall make any disturbance it is my will that such Legacie or Legacies shall have one shilling and no more. And I do hereby nominate constitute and appoint Abel Richardson and Edward Bridge The Elder executors of this my last will and testament hoping they will see the same performed as my trust is in them exposed and I do revoke and make void all former will and wills by me at any time heretofore made and do declare and publish this only to be my last will and testament in witness whereof I have hereinto set my hand and seal this twenty first day of October in the year of Our Lord according to the computation of the Church of England one thousand seven hundred and forty nine".
The will went to probate in December 1750, details attached to the will as follows...
"The 28th day of December in the year 1750
Abel Richardson and Edward Bridge The Elder the Executors within named took an oath of an executor in correct form before me H Wolstenholme.
Probate granted the 5th of January 1750/1" |
